    Lawsuit

    I got a call from collections saying that a lawsuit have been filed against me. What should I do next? I can't afford to pay, I have no job. Do I have to go court or anything? Are they just using this as a tactic to get me to pay?

    Have you filed for bk? If so, simply refer them to your attorney.

      I haven't yet, still comtemplating on whether I should. I owe around $40K total to 5 different credit cards. How can they file a lawsuit against me without contacting me via mail first? This is the first message I got from them about it.

      Man, I paid off 2 cards, close to $9k this past year in hopes of finding a job and to pay off the debt slowly but that didn' thappen. I'd feel like I've thrown those money away if I do in fact file for BK. Please advise.

        Go talk to an attorney TODAY!

        The moment you retain an attorney, you can refer your creditors to them. Once you file for bk, there is an automatic stay put on all of your accounts and all collections must cease immediately.

        Don't put it off any longer. From the situation you described, you are a prime candidate for Ch7.
