    Can I sue a LLC that is filing for bankruptcy

    I know this is not the usual question you get here, but I need help. I am a 25 year old helicopter flight student and the school that I was just with closed their doors and told everyone they were going out of business. Myself and many others had money on an account there to get discounted flight time. I want to file a small claims civil lawsuit before they have a chance to finalize their bankruptcy and I get screwed. So my question remains can I sue a LLC for the money I paid to get flight time, once they have filed for bankruptcy. This is very recent as of a few days ago, so I know there is no way they could have their bankruptcy finalized.

    Once they "file" BK: no, you cannot sue. About all you can do at that point is file a proof of claim in the BK and seek to have your debt considered a priority.

    If they have NOT filed BK, then you can sue.
