    Paying for BK - dip into profit-sharing funds?

    Looking for ways to come up with the $2200 I've been quoted for filing a Chapter 7. Since I don't have that in cash on hand, would it be possible to dip into my profit-sharing plan and take out part of what I have vested?

    Otherwise, can I sell some things on Craigslist or eBay to come up with part of it?

    I'll still have to borrow some from my parents - they'll be listed among my creditors anyway - since $2200 is a lot to come up with right now.

    02/12/08 - Discharged
    02/15/08 - Case closed

    I didn't know you could list your parents as creditors....
    Wow.

    When you stop paying your creditors, you'll free up money that you can use for the attorney. Most take a down payment and then payments. 2200 for a 7 is RIDICULOUS!!! Have you seen more then one atty???

      I'd agree with Citygirl.
      See another couple of lawyers. Unless you have something out of the ordinary in your bk, that's way too high.
      Also, stop paying all creditors you will include in your filing and sell stuff if you wish to pay your lawyer. Just don't sell anything of any value to a relative.
      The profit sharing plan would be at the bottom of my list as a fund raiser. The assets are exempt from creditor seizure and you may have some tax issues.

        That sounds a bit expensive, unless it's quite complex.

        Here are two new questions to ask the next attorney you get a free consultation from:
        1. Was the profit sharing a protected assset? Either as a Wildcard or Retirement account. You'll have to dig into your own paperwork to see if it's qualified as retirement. If not, it's like any old bank account.

        2. If you've got $2200 bucks worth of stuff you could sell on eBay, was your attorney protecting that?

        And yes, you need to disclose all loans, Mom & Dad get discharged along with Chase Bank. Be carefull about repayment to them before filing. That's a no-no. Afterwards is fine.
