    Hi!Can you be forced into Chapter 13 from Chapter 7?
    I live in MA-make 45k, owe cc debt of 44k had been living in an apartment for the past 8 years moved back in with the parents this year. Looking at filing probably in the fall Sept/Oct.
    Don't have any assets-own a 97 Accord.
    Will this be an open and shut case?
    Any thoughts would be great?

    Assuming you are a single filer, the median income in MA for one earner is $51,543 - http://www.usdoj.gov/ust/eo/bapcpa/2...come_table.htm . You are well under that.

    Unless there's some extenuating circumstance that causes you to have more income than half of $51,543 over the last six months before you file, then you are under the median for your state and can very likely file Ch 7.

    Given the information you've shared here, you can't be forced into a Ch 13.
