    Lawsuits and BK13

    Hi All,

    I have a question about a couple of lawsuits my wife and I have pending.
    All though both are still in litigation and neither award will be all that big less then $5000.00 in each one would be my guess after attorney fees.(one is for an auto accident she was broad sided by someone who ran a red light and the other one was from a slip and fall in a supermarket on a puddle of water by a produce cooler that was leaking. she was not seriously hurt in either one but medical bill were created by both.)
    Now I don't want to try to hide or decieve anyone and take a chance on having my case dismissed but what we do want to do is send $2000.00 of it to our daughter to help pay for her dorm room at school.
    Would that be looked upon badly by the trustee or court? All we want to do is help our daughter out like we promised her.
    The remainder we would split up evenly and send a bank cashiers check to each of our creditors.
    Or would there be a way that we could hold on to that money for our fresh start?
    Is there a time frame that would need to pass so that we wouldn't be lying about anything.
    Like I mentioned we don't have any intentions of trying to decieve anyone or want to create more problems then we already have if giving up the awards is the only way I'm all for it were just lookiing for relief.
    We were planning on filing some time in early spring or summer of next year.

    And there's one other question we may have made a big boo-boo.
    About 2 months ago we took a cc check that they send you in the mail and wrote it for cash then when it cleared we paid off a student loan my wife had.
    The check was for $2300.00 they offered us a good rate 4.9% for the life of the loan and was tacked on to the other debt we had with them.
    We were paying almost 8% on the adjustable loan we had with them.
    I thought we would be able to save a few extra bucks each month.
    IS this going to come back to haunt us even if we wait till next spring to file?
    It would be about 9 months before we quit paying and file.

    I would be grateful for any help or advice you could give.
