    Missing Document Question - HELP!

    I am all set to file except for one stinking piece of paper. It's my most recent 401K statement and I cannot get access to it right now. I'm trying to get it, it's just taking longer than anticipated.

    Chase has now officially filed suit against me. I was served today. I have 20 days to respond.

    I don't know if I'll have the 401K statement within the 20 day time frame. I meet with my atty on Monday to go over all the paperwork and I would call them now but they are closed.

    My question is, do you think I'll be okay as far as this lawsuit goes in terms of timing? Can my lawyer file me without this one piece of paper? I'm a little bit freaking out here and need some reassurance/guidance. This is going to be a LONG weekend if no one can help me....
    11/14/07 -filed C7 12/04/07 -case pulled for random audit.12/18/07 -341 held: Asset case due to engagement ring & tax return.02/19/08 - US trustee files motion to extend. 04/02/08- changed back to NO ASSET! I get my ring back and get to keep my tax return! :clapping: 04/28/08 -DISCHARGED!!! :yahoo::yahoo: 05/07/08 - CLOSED!!!

    Sorry you are having trouble getting this one form, DRM.

    Just trying to sort out why you can't get a 401K account printout. Many 401K accounts have online account access - is yours one of them?

    Did you call the 401K to ask for a printout of the account? Doubt they are open over the weekend, but will be open Monday morning. You can request a printout be overnighted to you to deal with an "emergency financial matter".

    What have you tried to do so far to get your account information?

    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      It's a matter of the 401K company changing their security measures and they assigned everyone new acct numbers which they mailed. I lost mine and have been waiting for a new one which I (thankfully) got in the mail today after waiting a month!!! I now don't know my PIN number though so I'll have to call them on Monday (now that I finally have my account number) and ask them if they can either tell me my PIN (which I doubt) or mail me a new one. They won't even talk to you on the phone until you get your account number in the mail and now that I finally have that, I may be okay. I guess I'll find out on Monday.

      I was just wondering if there was any way the atty could file without this paper. There has to be emergency situations like this out there and provisions for such I would think.

      I'm keeping myself REALLY busy this weekend so I won't think about it. It's working so far.

        ERISA qualified plans are Exempt.

        The attny is gonna need to list the name of the Financial Management Company, and/or the Employer, and the $$$ amount your investment is currently valued at.

        I'm not sure if a copy of the Statement is sent with the rest of your Documents to the Trustee,.............. Or, if your attny just keeps that information on file.
