    Foolish to file?

    I'm ready to file Ch. 7...my credit was never good after my divorce and due to a few personal issues starting last summer I wasn't able to make some credit card payments, and it spiraled from there. I don't have HUGE credit card debt, only about $6000 now with all the late fees, etc. I also have another $5000 in misc debt..medical, old bank account fees, etc. So about $11,000 in dischargable debt total.

    I'm at the point where I want to file just because it will clear my credit a whole lot faster. Even if I were to start making regular payments on my CC's I'd still be getting $60/month in late & over limit fees on 5 credit cards....so it will perpetually continue on like this forever unless I have a major influx of cash. Not likely.

    I run my own business and gross $24k/year, my adjusted gross after write offs was around $12k, but I also get $1,000/month in child support. Do they go by gross on a self-employed, or will they consider my expenses/adjusted gross from my taxes? My living expenses are average. Basically I have about $2,000/month, 2 kids, live with someone and share expenses. I get by, I have some money left over, which I could technically be using to pay debts, but haven't been since I decided to file...because it all seems pointless sending them each around $30 a month which would only cover half of what they are charging me each month!

    Am I going to be laughed out of court and told I can't do Chapter 7 because my debts are fairly low (comparatively) and I do have an income? I can't even afford a lawyer right now, but I'm afraid the court will say I have all sorts of money laying around for me to pay my debts Help!
