Spoke with an attorney today bout filing BK and he said we are not eligible for a chapter 7 and he dosent sdvise a 13 due to the fact I amy lose my job due to the military moving my spouse. Well credit counseling will not help I wont have any money left for living. A debt settlement company has already screwed me over and BOA wont except there proposal and I am recieving letters from a law firm threating to take action. I cant do anything I guess. What if they sue me what happens. They cannot touch my home due to the fact its in my husbands name. I am letting my car get repo but my husband has 2 so I am okay there. From my understanding they can take me to court and the judge can take up to 25% of my pay but for how long? I have several crediters after me due to the failed debt settlement company.

We are over the median combined by 12grand for a family of 5. if you add my credit card exspense I am in the negative. I am an idiot I cant believe I let myself get in this shape. I am worried that I will still not have anything left over if I file 13 I dont have any disposible income due to being so far behind on bills. i am just worried that if I do a 13 and then we get transfered I will be out of a job and will not be capable of paying my payments to my trustee. Then what would I do?

It's a strange suggestion, but I think you should quit your job to get below the median and file a 7. It doesn't sound like you have a lot of tenure at your job and plan to stay there awhile anyway. Just my 2 cents.Filed Ch 7 - January 29th, 2008

If you think you are screwed now wait till you let your lender sell you car. They have no incentive to sell it at a market price. Who gets stuck with the difference from what it sells for and what you owe, it is you.
So if you cannot pay for it or work something out then sell it yourself. They need to agree with it so they will release their lien.
