We still haven't filed. Now I'm thinking we should wait until after the holidays. We don't have the $2000 to file right now and I think I'll probably use my Christmas money to pay the lawyer (My dad usually gives us $1000). One of our creditors has already filed suit. I answered the summons, but haven't heard anything yet.
I do talk to some of the collectors now and then to let them know I can't pay right now. Early on, before the problem got out of control, I tried to make attempts to work things out with lowered interest and lowered minimums until we got back on our feet. Everyone wanted check payment by phone, no one would send us an agreement by mail where we could mail a money order. Worse, some of them would say they needed a minimum payment of $1100 or more dollars to bring the account current.
Yesterday, I received a call from a collection agency representing our largest credit card debt, $18,000. The lady was nice and explained that this particuliar creditor is really tough and will usually not work with a client. She said that they'd most likely sue within 60 days. She suggested that we may want to consider filing for bankruptcy. I couldn't believe it. Has anyone else been in such dire straits financially that a collection agency had suggested bankruptcy? This isn't the original creditor either, it's a collection agency that I read has a pretty mean reputation. My sister wondered if they were going to play a game of "good cop, bad cop" somehow. I thanked her for her advice and said I'd look into seeing a lawyer.
I just thought it was a strange experience.
I hope we can file soon as this is getting to be too stressful. I feel like every nerve in my body is on fire and everytime I hear a car outside, I think someone is coming to sue us again. I can't concentrate on my college classes and I'm just generally scared to death all the time.
Yesterday, we got a strange call from a number that I traced online to a skip trace company. I just want this nightmare to end. I am getting totally paranoid about everything and I'm actually afraid to go to the lawyer. The creditors are having a field day with adding fees and interest to the balances, I think the total balances have jumped over $10,000 since we've stopped paying. One creditor is adding $500 a month just in interst and fees.
I'm embarrassed to even go outside because I think that creditors may have called my neighbors.
