    You haven't filed yet right? Put everything into the Bk. Close the old bank account (keep the new one positive of course) put the medical in the BK, the OD'd account, absolutely everything. Now, did I read that you are giving your ex money? But he isn't paying child support? That part confused me. But I would take a step back and look as objectively as you can at your situation. You need food/gas/ roof over head/vehicle. So spend your money on those items. Is your car running now? Is it paid for? Call the attorney you have retained and let him know what is going on. Maybe you and your child can limit Christmas this year to get it done.

      SCG, you have alternatives to get your non-paid child support without going to court. All you have to do is visit your local courthouse with all your ex's information and request that the clerk issue a garnishment against your ex's wages. Simple as that.

      Your state may have specific options as well that you can do yourself for very little. Call your local divorce court that granted your divorce and ask for the clerk. Find out what your options are. Don't assume you need to pay a lawyer to go after your ex - you don't.

          I don't think you can close an account that's in the red (and sorry for misunderstanding your first post).

          Leave your current account in the red for now to keep your credit union from allowing the payday folks another payment. Go open a new checking account at a totally different bank (don't use another credit union). Personally I find locally owned banks much more helpful than the big bank conglomerates with their mega-branches. Keep us posted, SCG - hope everything works out for you.
