    employer notification?

    My question is will my wifes work be notified if she files bk? she works for a retailer that offers credit but we do not have an open account with them.

    if you do not have an acct, they should not be notified. I know several people who filed, and including our filing, employers were not notified for any of them.no one had credit accts with the employer, even when it was available

      The employer will not find out about the bankruptcy unless they see it published in the newspaper (it's public information/record) or someone tells them. If you don't want the employer to know, do not tell anyone in the office about it or the situation and do not discuss it on the phone in the office. Also be careful of what is left on the desk or computer screen when leaving the office area. Office gossips are in every office and walls have ears.

        Actually, if she files a 13 it is possible that her employer will be notified if her bk payment is deducted from her wages. My BK trustee made me pay this way. Fortunately, the payroll dept just did their thing and my immediate supervisors never knew.

          They probably won't be notified, and even if they found out, I wouldn't be too concerned. Most employers could care less.

            Payroll and HR cannot divulge any informatoin internally or to an outside source about an employee. The only way payroll and HR can divulge information internally is if the higher ups request that information for some company reason if they are investigating you. So say you have the situation where you work for one person and that person is your boss and pays your payroll and you have payments for your Chapter 13 deducted from your paycheck. While that person will eventually learn of your Chapter 13 payments due to privacy laws he/she cannot divulge what is coming out of your paycheck nor dilvulge the information to any outside source or anyone else inside the company about your payments. Also, you cannot be fired for the specific reason that you filed bankruptcy.

            While bankruptcies are public information, information on what you are paid or your deductions from your paycheck as to your employment is protected by privacy laws.

              When I filed a Chapter 7 in 2004 old laws - I had been working for a bank for almost ten years - but did not have any loans or credit cards through/from them. So they were not included in my filing. They never found out that I had filed.
