? RE bank accounts

    ? RE bank accounts

    I have accounts with USAA. I don't have any loans thru them, and nothing from them will be listed for discharge when I file in a few months. So I assume I'll be OK with them to leave my accounts where they are.

    Do I need to worry about other creditors getting into my bank account after I stop making payments next month? I've always paid either thru online bill payments or with my debit card thru my checking account.

    There's always a chance they can find the account. They have to go through the normal court procedure to levy your account though, unless they somehow get a default judgement. The best thing to do is make sure you're address and contact info is correct with all your creditors. This will eliminate anyone getting a default on you by serving you at a wrong address. If you do get served, or think it's coming down the pike, don't leave much in the account.

      Is is common for a creditor to sue after only 60days or so? I am current on everything right now, but will stop paying with January's payments and will file in mid-march, once it's been 90days since we used our CCs for purchases.

        Common? No. Possible? Yes. You really can't know when it's going to happen, or if it even will. If it does happen, you'll know in advance, when you get served. There's quite a few posts here that will go into more detail. In most cases you really only need to worry if you delay filing. After a while creditors get tired of hearing you say you're going to file and they just move forward on their own. But, it sounds like you're going to be filing around the 90 day point, so I wouldn't worry too much.

          I have EVERYTHING through USAA. Well, except for the debt I'm discharging. USAA has to one of the best deals ever. I have my checking, savings, life insurances, homeowners ins, auto ins, mortgage, and auto loan through them. So far I haven't heard a peep out of them about my bankruptcy. I actually have a credit card though them and they haven't closed it yet. The credit card has a zero balance but the limit is 18K. I'm hoping it lasts though my whole bankrupcy.

            I have my car insurance through USAA and not only are the payments great but they have been so nice working with me. I haven't been able to pay them in a while and they worked with me with a new payment plan.

            I also have a credit card with them which is maxed out at 1000.00 but current.

            I am filing at the end of January or early February and don't want to default on them. I really don't. I hate the fact that I will have to list them on my BK. I can afford to pay them if I don't pay anyone else. I can probably pay them off in a few months if I don't pay anyone else....but then that would be preferential payment. (actually there are a couple more I want to pay but that's another thread).

            I am wondering if I should just go ahead and call them and explain the situation...including the fact that I intend to continue to pay. I don't care about being able to use the credit card though want to pay it...just really want to keep my car insurance with them.

            Any thoughts?

              I actually had a balance on a credit card with them and I transferred it to another credit card. Then I waited like 4 months before filing. I read somewhere online about someone who had a bad experience with USAA when they filed bankruptcy. They were denied access to their online account. I don't think they know about my bankruptcy yet because I didn't have to include them on anything.

                I read this too, but I think it was for people who included something from USAA in their Bk?????
