    How long from repo can I put off filing?

    How long do I have from the moment a car is repo'd to the point when I will want to file bankruptcy? Meaning, how long does it take them to sue me? Can I send them $10/month to delay the suing? If I wait until they sue to file ch 7, is that bad? If not, how long will I have to file after they sue? Main thing is I can only save $300/month for a lawyer and I imagine I need $1200 or so?? That's 4 months.. I cant just get a loan, use a credit card or borrow from family to pay for the lawyer. I'll be taking the bus as it is..

    It'll take months from the repo before you are sued {if ever}.
    Any judgment related to a deficiency balance can be discharged in bk. Sending a minimal amount a month will not stop collections.

      Well, since one has nothing to do with the other, you can file when you want!

        It'll take months from the repo before you are sued {if ever}.
        So you think maybe I could skip filing for BK and just let them write it off? What looks worse?

        I owe 12K on the car. It's worth maybe 5-7K. Then of course collection fees/etc. So what, I will still owe 6-9K afterwards? Will they sue for this amount?

        I also owe one medical debt of $5K. And a few others of smaller amounts. Will they sue?

        If no one is gonna sue it seems like the easiest thing to do is let the car get repo'd and forget about it. But if they're gonna, seems easier to do a BK and get it over with.

        Thoughts??

          Personally, I would fear the potential judgments more than the bankruptcy. That is also why I would hire a lawyer to do it, not do it pro se.

            I'd just be in no hurry to file. So what if they sue? You can file bk at that point. Many members have had a lawsuit as the catalyst for filing. Nobody cares how it looks.
            The previous poster is correct. Nobody can say with any degree of certainty when or, if you'll be sued. Point I was making in response to your first post was, you got plenty of time to save money for legal fees.

              The only problem I see is I still want to get another car, in $1500 range. And It will probably take me 5-6 months to save up for that. I'd hate to just get the car and need to file BK right after and have no lawyer $.
