    Effects of judgment

    I'm in a field of employment where from time to time I must get a police background-criminal records check.

    If a judgement is successfully lodged against me then what?

    Is is a just a credit check issue or something more?

    Most employers get a criminal and credit check in the pre-employment phase.

      The impact of a legal judgment for not paying a personal bill depends on how your employer feels about their employees being in financial trouble related to how much finances are a part of what you do for your job. Some employers couldn't care less, some care a great deal. There's no way for us to predict where your employer is going to fall along that line.

        After the judgement your employer might find out away with out checking, after the suit you may end up the a payment garnishment. You can drag it out a little. There is a form you fill in with court to say that you are going to fight the case. The court then will postporne the case to a later date, then as it gets close to that date you request a postpornement for maybe filing BK or something else. I know this seems weird, but it's all a game; you just have to play it a bit better.

          A sheriff showed up at my Mom's House looking for me I believe they were looking to serve me on a process for a judgment on a deliquent acct.

          I don't how long I have but I'm not in a position to fight it in order to prolong things, I just don't have the opportunity to address it I don't think.


          I'll be OK with my employer on garnishment, I believe I'm safe, no problems there on that affecting how I am paid.

          Mainly worried that a judgement on an unpaid personal loan/ bill does not show up on a criminal record check. Showing up on credit check is not so good but I can live with that at least for now.

          I am worried about how much time I have before they attach my checking account.


          I think I will have to file BKK but I am trying to stretch it out for a while longer. Now is not a good time.

            IMHO, a judgement would not show up on a criminal backround check unless there was CRIMINAL charges filed and brought against you.
            If there were no criminal charges brought against you, and you were never found guilty of a criminal act, there should be nothing on your criminal backround check.
            If however, say you wrote a bunch of checks that bounced, or on a closed account, and a creditor took you to court for fraud or similar criminal activity, and you were found guilty in a court of law, this would be part of your criminal record.
            You would be the one who would know, and food for thought--if you keep avoiding getting served whatever papers, eventually a hearing will happen anyway, even in your absense--and the plaintiff will win by default no matter if their claim is true or not--and you could well end up with criminal charges. Better to accept the papers they are trying to serve you so that you can defend yourself, anything else is counter productive. Take the papers--it's easy to postpone many court proceedings--attornies are famous for postponing things forever--If you're gonna use a 'stall tactic'--do it the right way, and cover your butt!!!

              ok thanks for the advice. I have not done anything criminal. But I don't live in the US right now. I have a wife and family and live in another part of the world. I cannot imagine how I would fight it.

              Have my mom mail me the letter and respond from here ?

                Well, that's a good question! I suppose you could have your mom mail it to you and deal with it from where you are. Do you have any idea what it is about?

                  Oh Yea, I got in cc debt over my head some time back quit paying on some cards and now I'm in default.
