    341 Done

Just finished the 341 on my borderline chapter 7. It seemed like I had the easiest "interrogaton" of the 4 that I saw. I'm not sure if that's a good/bad thing in terms of being converted to a 13? I'm about 12K over median, but didn't get drilled on that fact. Maybe that's not the type of thing they bring up in a 341. Very standard questions with no controversy...lasted about 7 minutes. The 341 before me lasted a 1/2 hour and there were all kinds of wierd things...
My attorney seemed very optimistic and he said that my case had already been "audited" by the US trustee. I didn't even know that happened...my attorney said he had handled it, that's why I didn't know about it. Also, my attorney said we should be discharged in 90 days. Sounds pretty good so far...just wanted to post an update. They do want my tax refund though...I'm a major dumbarse and had too much withheld. I tried to get it around $0, but didn't look at the numbers close enough.
Anyone else had a positive experience like this, only to be burned shortly after with a chapter 13 conversion?

So, what happens now? Does the trustee present a recommendation to the judge? Since I'm borderline 7/13, I'm pinning my hopes for a 7 on the fact that the trustee said he would be requesting a "tax refund order" or something like that. I'm assuming he wouldn't bother with that if the plan was to convert me to a 13, but maybe the trustee isn't even the one who would push me into a 13?
My attorney gave no indication that our ch 7 discharge was in jeopardy, but I've been surprised before on other issues. As I mentioned, my case has already been reviewed by the US trustee, so I'm not sure if that means anything. Would the US Trustee be the one to recommend a conversion to a 13? I guess I'm just looking for something to worry about...lol. Anyone have any ideas on this?
          Thanks,
