    Are both filers required to go to the 341 meeting?

    We live in CA, are filing Ch7 jointly...will we both be questioned at the meeting? I need to prepare my husband, he's deathly afraid of courtrooms, judges, etc.! Thanks for you help.

    I am almost certain you both do - check with your attorney. You have to provide photo ID to the Trustee to prove you are the actual filers.

      Yes, both must go.

      Also, keep in mind...in most districts, the 341 meeting is NOT held in a court room nor in front of a judge. They are usually held in a conference room. There will be a table at the front of the room where the trustee sits and rows of chairs for all the debtors to sit who are scheduled to go for that block of time (usually 1 hour blocks). Then each debtor is called up to the table to be questioned by the trustee (341 meetings are rarely, if ever private, so be prepared that there will likely be people, other debtors, sitting there watching you).

      If you are really concerned, simply go down an observe how 341 meetings are done.

        In a friend's BK back in '78 it was in a courtroom, a big one with lots of people! I do plan on sitting in to see, it'll take some of the anxiety away....I hope! Thanks for the input

          It's usually much less intense than a court room and the Trustee is usually much less intense than a judge.
