341 has come and gone...

    341 has come and gone...

    And we survived. It was Wednesday at 9:30 a.m. We waited the hour or so (called up around 10:30) and was over in about 5 minutes after about 8 questions.

    Tried to heed everyone's advice here and remained calmed and everything went super smoothly.

    I asked our attorney afterward, "so it's just wait and see for the next 60 days?" and he said, "Oh, you'll get your discharge."

    So thanks for everyone's help on here. We've pretty much given back all our secured property and are moving to my parent's rental in about two months. We get to keep our tax refund (state and federal totalling about $3,200). And with my 401(k) from my last job I cashed out, and upcoming rebate check in May, we should have a decent savings hopefully.

    Thanks again to everyone for your help! Hopefully we'll be home clear in 60 days give or take.

            Thanks again everyone.

            I just wanted to say there was a minor glitch(?). When we had received copies of our schedules (or whatever the name of the document was that lists our assets and debts owed) I noticed that one of our Bank of America loans was not listed. We had two credit cards with them and a loan and the two credit cards were listed but not the loan (and this was the largest about $18,000). I called and spoke with the paralegal who told me that as long as Bank of America was listed as a creditor on there (they were for the other two creditors) then that was all that was needed. I felt unsure but figured they knew what they were talking about. I had also mentioned this to the attorney who said the same thing. Again, after reading stuff on here I still felt unsure but figured this attorney has been doing this for 25+ years, so he should know.

            So, the morning of the 341 meeting comes and we're waiting to be called and I keep hearing the trustee ask the people up with him if all their debts are listed (not creditors mind you, but debts). So I called my attorney aside and reminded him about the 3rd BOA debt and said "So, if he asks us if we read this and is all our debts listed do I say yes, all but the 3rd BOA or do I just say yes and nothing further or what?" He again said, "BOA is listed for the other two cc's so it doesn't matter - you would just say it's correct."

            Well, I had already made up my mind that when the trustee asked us that up at the table that I was going to say it was correct except for the the 3rd loan that was left off for some reason. When we were called to go up to the waiting area before the trustee's table my attorney motioned me over quickly and said, "I'll let him know about that 3rd BOA loan when we're up there". That would be nice I was thinking. So we get up there and the trustee asked us the question about all debts listed, etc. and our attorney let him know that all of BOA but that one was listed, so the trustee kind of looked at him oddly and said, "Well, are you going to submit an amendment to that? and our attorney said, "of course". So now I'll need to call his office this week and make sure that is going to be done soon.

            Maybe all would have been or would be okay if that particular loan was never mentioned even though BOA itself was already on there for two other debts but after reading things on this board, I really didn't/don't want to take that chance.

            So, at any rate, in a round about way I am trying to say thanks for all the great info on here that everyone shares to try to help the next person out and hopefully that issue will be resolved this week and I can get on with things.

            Oh, and this is what the latest says on Pacer about our case.

            "Minutes Of 341 Meeting, Attorney Present-Debtor And Joint Debtor Present-, Meeting Held, Report Of No Distribution - The trustee reports that the trustee has neither received any property nor paid any money on account of this estate, that he has made diligent inquiry into the whereabouts of property belonging to the estate, and that there is no property available for distribution from the estate over and above that exempted by the debtor, The trustee certifies that the debtor(s) identity has been verified by appropriate photo identification and the debtor(s) social security number(s) has been verified by appropriate documentation. (Harden, Holmes) (Entered: 03/07/2008)"

            So hopefully this is good?

              So hopefully this is good?
              Yes, it's good - means the trustee accepts that what you've exempted is correct - he's not going to challenge anything. Now you just have to wait out the next 60 days - you're on the downhill slope coasting home! Congrats!

                It sure feels good when it's over, doesn't it? I took got to keep my tax refund, and with the tax rebate coming up, I will at least have more than $50 in my savings account LOL

                  Yes, it feels good. I just hope there's no snafu's with the creditors until we're discharged, but hopefully it's only a waiting game until around May 1st or so...

                      that's my hope too I have to wait until May 5th or 6th (can't remember off hand which date exactly). My attorney said it should take 90 days for the discharge to go through. Sigh. I'll be so glad when THAT'S over with!
