    Dependant income

    My 22 yr old learning disabled stepson lives with us and always will. I have carried him as a dependant on my taxes ever since his mother and I married (7 years). He does work a parttime job bagging groceries, last year had $6000 income. My wife and I will be filing jointly, will his income come into play anywhere in filing. Thanks.

    If you look at your state exemptions, you might see something about wages of a minor being exempt. I'm not sure if that would help since he's not a minor but is still dependent. Hopefully someone here can answer better!

      Different situation from yours, but my stepson (12) recieves social security death benefits (for his mother who died) of about $5000 a year and it was not exempt. I'm curious if he gets a job when he turns 16 (just a little over 3 years from now) if they will want to amend things to include that? Although probably not since the lawyer said the trustee only cares about things that change our income by more than 10%, which I doubt that would...

      Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!

        I also know that they include child support, which you would think would be exempt if wages of a minor are exempt, but it's included in household income.

          His income is part of your household income. To claim him as a dependent on your taxes you must provide more than 50% of his support each tax year even though he is now an adult. He will need to be factored in as a dependent for your filing and you will include his income in the total household income.

            Thanks all for the replies. Not the best news I've heard today but so it goes. Plus my wife just told me that as of January he started getting $400 month from SSI. We don't take money from him for r&b but I think thats about to change, jeesh the kid's got more money then we do.

              My 16 year old daughter works at McDonalds and makes about $125-150 a week. Our lawyer said that we have to give him her paystubs to include in the household income portion.
