    what are my options

    hi i filed a chp 13 @ 9:41 (filing time) on june 9. I had a case in gen district court @ 9:30 the same day. this case was not called before the judge until well after 10:00a.

    Since the bk was filed, i did not report to the gen district court, and a judgement and immediate possession was entered that day.

    My landlord has ordered eviction (ie sheriff) scheduled for the 14th of this month.

    Can I stop the eviction. What should I do? Can I have the judgement thrown out, because of the automatic stay with the bk?

    I am in Virginia

    Kind of waited till the "last minute" didn't ya???
    You may have cut it too close......

    I would say you can plan on moving since you are renting...

    I don't believe your filing BK will affect the landlord putting you out in any way. If you thought that might prevent eviction - I doubt it..

      I guess I dont understand why didnt you appear in general district court? I know you probably thought the BK would grant you a reprieve but apparently that is not the case. As Minnymouth said you may have cut it too close. How many months behind are you? Is there anyway you could work something out with your landlord? Otherwise, I think you might want to pack. Sorry. Wish we could help. Let us know.
