We have been waiting to file our chapter 7 to put some time in between some large cash advances and the time we file.
We were just served with a summons to appear to court from our credit union for two autos that we surrendered months ago. THe court date has been set to the 21st of July.
If we were to file around the 15th of July, that would give us about four months time since our last cash advance or credit activity. With this date we can provide 3 months of good bank statements not showing any credit card cash advance activity.
Q#1 Should we file before the court date of the 21st? I was hoping to wait until August 15th or so to put more time between cash advances and filing date...unfortunately using this date would mean I would have two judgments for these repos to list and have heard that judgments complicate things.
Q#2 Should I file in August and list the judgments in the bankruptcy papers?
I have heard of notifying the court of an intention to file bankruptcy before the court date...would this solve my problem?
I am looking for all your thoughts on the best way to organize my filing....any help would be greatly appreciated!!! Thanks!!!
