Where will my BK court be?

Hi gang. I originally came here about 6 mos ago, with lots of questions, and you were extremely helpful. So, I am returning as I will be filing soon, and have an appointment with an attorney this week.

I have one basic question:

*Where will my court be?

I live just across the state line in Mississippi, but I am included in the greater Memphis, TN metropolitan area. I called several attorneys, and was told that I must file where I reside and get an attorney licensed in MS. Does this mean the court will be held in Jackson, MS (I know BK court is held there) ?

Anyone with any experience?

Mississippi and Tennessee are in different bankruptcy districts - MS is in the Fifth District and TN is in the Sixth District.

Whoever told you that you have to file in the state you live in is correct. The only exception is if you have lived in the state for less than two years - have you?

MS has two bankruptcy districts - Northern and Southern - http://www.bankruptcyinformation.com/MS_courts.htm . First check for the county you live in, then look for the closest court location to you. HTH!

I have to add that when I look at my BK courts for TN, I'm included in the Eastern District, it shows the nearest court about an hour away, however, I'm having my 341 at another courthouse which is about 30 minutes away. They are all in TN. Just ask your attorney where the meeting will be held.
