    Charitable Contributions

    Lets say you have to wait 6 months before filing, for various reasons. Is there anything wrong with increasing you charitable contributions during that time, so that when you go to calculate the means test you have additional charitable contributions you can add? is there a limit to how much you can show for Charity on the means test?

    1. You need to have DOCUMENTATION of the contribution (i.e. cleared checks, a receipt--with amount, date, etc).

    2. In general, your charitable contributions cannot exceed 10% of your gross income.

      Is this a typical pre-BK tactic? Since we would be stopping payment of our credit cards, we could take a small portion of that money (say $50 - $100 each month) and put it towards our favorite charity and help our chances on the means test (with appropriate docs). Just wasn't sure if this was technically fraud or if we would be forced to show that we have been making these payments longer than 6 months

        Legal stuff aside, wouldn't it be better to find another 50-100 dollars worth of expenses for stuff that you actually need?

        I'm thinking that if you have to file BK, you shouldn't be giving to charity at all.

        Charity begins at home. Trite, yes, but I believe it.

          I agree, but I am looking at it strictly as a pre-filing tactic.

          Even if we could find an additional $50 of expenses, what types of additional expenses could you use on a means test?

            How did you calculate your expenses? Did you go by receipts, did you guessitmate, or are you using the maxumum allowance for your family size in your state?

              Over the counter meds. It's allergy season and allergy OTC's are expensive.

              That would get you at least $25/month.
