    been lurking in the shadows

    long story but gona try and make it short as possible.lets just say we had 25k worth of unsecured debt at the time.my other half had quit work was gona be getting a job then found out had medical probs that had to be dealt with for the next several months and in between time there was roughly 20k cashh advanced in 2 differnt times to help tie us over.last one took place 05-07.then to top it off place i worked for closed 07-07 and i pulled another 10k 09-07.so today we are roughly 50k unsecured in the hole and neither of us working as the job market is in the toilet.guess I am wondering how that will be looked on if I was to file a chapter 7 down the road.

      yes i have but the time is coming to where i wont be able to shortly.my credit at this point is spotless but without income and owing 50k it wont be for long.thks for responding

        Your past the 70/90 day rule and you've been making payments so you should be ok. Just try to put as much time inbetween the advances & filing as possible.

        More importantly, as HHM pointed out in a different thread, you need to find employment. But if you plan on filing, do your homework in terms of the median income for 2 people for your state. You don't want to go above it or you can be pushed into a ch 13 which would suck.

          thanks for the quick responce.i am wondering if it will it be looked up as fraud perhaps seeing she pulled 20k when wasnt working and i pulled 10k when on unemployment?Yes we both need jobs I understand for several months before we could consider filing.Far as meeting the medium income there wont be any problem there seeing best job if can get would be around 8 to 11 bux a hr.

            Sure, they could object based on insolvesancy at the time you took the advances but is that going to stop you? Do you think you will ever have a way to pay back?

                also when place closed in order for wifes insurance we have been paying the cobra premiums out of the advanced money since 07-07.dont know how much longer we can keep up with the cobra pyments either .but have current copayments for 08 rolling in also now

                  Those cash advances are not that recent-one will be a year old next month. I'd stop paying all debts you wish to discharge and file whenever you're ready.
                  For sure, get some sort of job ASAP.

                    thanks for the responce keepmine also.what happens if i quit paying on credit cards but keep paying on current medical bills i just received? Id hate to have them cut services to the wife for nonpay.so if I quit paying on credit cards what generally is the time frame before I would be sued on them also?the way it is right now without jobs I can buy bout 2 more months before completly broke.
                    The job situation as you all know sux when your looking at 80 mile drive round trip on a 8 to 11 dollor hr job.Id consider moving but our 30k house is exempt here which has been bought paid for in early 90s which gave less then 10k for it at the time.

                      Yeah, you have to prioritze. Pay the medical debt and let the cards go.
                      Who knows how long before {or if you get sued}. Some are sued ina few months others in a few years.
                      Once you file and are discharged and closed, I'd sell the house and move where their are more opportunities.

                        And start meeting with lawyers. You can schedule intro consultations for free. Meet with 3 or 4 in your area and run your situation by them. You'll get a feel for various perspectives on your situation. Meeting with attorneys also makes this process more concrete, takes it out of our head.

                          few more senerios.spose I would buy a ac say for 500 bux for house and say roughly 1k for home maint repair.And used cards to puchace daily living expences suchh as food etcfor a month or so.while still making the minum payments on cards for next 3 months would that be considered ok?

                            IMO, if you can't afford basic necessities without using credit, you don't need to file bk yet.
                            You need a job of some sort. Flipping burgers, stocking shelves-anything to get some cash rolling in and at least buy groceries.
                            While the expenditures you describe would not be luxury items, I'd wait longer than 3 months to file. For sure don't file until your finances are somewhat stable. At least be able to afford food and utilities without using credit.

                              thanks for responce keepmine btw what does IMO stand for?also say spose instead of just charging groc etc for next few months.spose just pulled another cash advance and was able to make minum payments and all expences for next 6 months?
