    long time waiting.........

well hello everyone i havent been on here in like 3-4 mos,

i got some questions that i need help on clearing up,

i plan on file ch 7, probably have 40-45 k in debt,

it been about almost 10 mos without paying the debt,

it seems all my debt have been turned to collection agencies,i dont know if thats good or bad,

1st question how long is too long to wait for filing?

    2nd, i make 9.00/hr working 30hrs a week now
    and i may get a 2nd job starting 7.25/hr

do u thinks it a good idea to work 2 jobs, will i meet indiana state
median, how will it look on the means test?

im also taking care of my family so 2 incomes is needed to get by
mom, sister, im 20 and my mom got laid off, unemployment ran up
so im like the family care taker now

trying not to go into 13 b/c i have nothing, so no point to file 13

    any advice?

    thanks for the help

Any particular reason why you are waiting to file?

Most lawyers would say if you are served with notice of garnishment or repossession of assets, it's time to file before the hearing happens.

If this has been your income pattern for the last six months, then you are working poverty wages well under the Indiana median income. Even if you get a second job, you'll still be under median income.

Why do you think you would be pushed into a 13? You don't make nearly enough for that to happen.

Unless there's some reason not to file now that you haven't shared (large cash advance in the last 70 days, large luxury charges on credit cards the last 90 days, etc), there's no reason not to file now. Have you discussed filing during free initial consultations with several bankruptcy lawyers in your area? There's no obligation and you can find out if there is a reason not to file now.

I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

    06/01/06 - Filed Ch 13
    06/28/06 - 341 Meeting
    07/18/06 - Confirmation Hearing - not confirmed, 3 objections
10/05/06 - Hearing to resolve 2 trustee objections
01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
Countdown: 60 months paid, 0 months to go

Definitely agree with lrpn, unless you have a reason like already stated to not file, there is no reason why you should suffer any longer. Go ahead and file, start the recovery process.
      Filed Ch 7: 12/27/07
      341: 2/6/08
      Discharged: 4/11/08
      Finally closing: ???
