Ok, just to add to my BK thing, my girlfriend is 2 months pregnant. She does not live with me but I am going to be financially contributing of course. So can I claim a monthly expense in BK for this?

You can't count an unborn baby as a family member for filing purposes. If it's important to have the extra family member to make you eligible to file Ch 7, then you'll have to wait to file until after the baby is born.
It's always been interesting to me that some of the major lobbying groups in Congress that pushed through the 2005 bk legislation are also strongly pro-life and believe that life starts at conception....except when you file bankruptcy and can wipe out debts you owe them. Then the baby has to actually be born first to count. How ironic.Last edited by lrprn; 05-10-2008, 12:06 PM.I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

That also depends of course if the OC and his girlfriend officially get married before the baby is born, and adds his wife unto his health insurance.Originally posted by keepmine View PostDon't even think about filing until after the baby is born. In the unlikely event there are any complications that give rise to latge medical bills, you'll want to be able to stick those in your bk.
