    bk 13 trustee payoff

    Im into the second year of trustee payments and may be planning to payoff,im concerned the mortgage company will still try to take the house.
    Can they do this if payments are current?This has been a nightmare dealing with our mortgage company.thanks

    First off, if you try to get out of you plan in under 36 months, you will have to pay 100% to your unsecured creditors (regardless of what your plan dictated).

    How are you planning on paying off your chapter 13?

    When you filed chapter 13, were you behind on your mortage, i.e. was part of your chapter 13 plan to pay back mortgage arrears. If so, you need to make sure that all arrears have been paid by the trustee.

    Otherwise, if your payments are current and there are no past payments due, the mortgage company cannot foreclose on your house.
