    Just thinking of filing bankruptcy.... soooo tired of trying to stay one step ahead of the next bill. Never thought this day would come but I really need a fresh start. Never paid a single bill late until 6 months ago. Tried to refinance my house to pay some bills but we pd our mortgage late ONE TIME and the bank won't touch us now. 20 years of perfect credit and now this. Sigh.


    I am wondering - do I have to file in the county that I live in? I know bankruptcy is a federal issue so can I file in another county as long as it is within my district? I am a public person and REALLY do not want this in the local paper.

    Also, I need a new car. Mine is 10 years old. I am planning to buy a new (used) car for $14k. Can I do that before filing? Or is that bad?

    I have not called a lawyer yet but plan to.

    Your attorney will file your BK in the district and state in which you reside. Bk is public information and filings do appear in some papers and in our state they appear statewide on a weekly basis in the main daily newspaper in the Business Section. Unfortunately, there is nothing you can do to keep your name out of the paper if they are published in your area newspaper and I really wouldn't worry about it too much. Filing BK does not carry the stigma it once did and you'd be surprised at how many people probably know you are having financial difficulties if you are a public person.

    Since your car is so old and in the event you file a Chapter 13 which can last from 3 to 5 years, your car will not survive. Most people in your position obtain a newer vehicle to get them through that time. I certain wouldn't go out and get a BMW or anything similar because that would not look too good at this time, but get something that is reasonable and that will be reliable for the next several years.
