    UST request to file a motion to deny

    Hello
    I am in the middle of Chapt 7 and have recieved notice that the UST is filing a motion to delay as they want to deny the dishcarge of debts. I do not understand what I have done wrong and cannot get an answer from my attorney. Can I fire my attorney and hire a new one in the middle of this mess?

    You're going to have to post more specific details about your BK 7 petition, in order to provide some level of assistance to you. What does your attorney exactly say to you when you ask "what's wrong". Getting a new attorney is possible, but finding once that will accept the case is another story.

      UST request to file a motin to deny

      The Chap 7 is all credit card debt and my income has been cut in half. I felt this was my only way out. I paid this attorney in advance 2 years ago and the paperwork got "lost" as he put it. He says he has not been sent any paperwork on this current motion and that I am to fax them to him. (Per his receptionist, he was not available when he found out it was me who was calling). My attorney does not return phone calls. He took 2 1/2 years to even file the BK paperwork and I am really now not sure what to do.
      I have tried to go to his office, he is not there. I call and he is "out" or in court. I leave messages which go un returned and this has been going on for over 2 years now. I needed help filling out the "workbook" and I got none, so I am not sure that I filled it correctly. He really has never looked at my paperwork, he just had a secretary file it, had her call me and tell me to show up at the trustee hearing, and then had to call my name when he did get to the hearing as he had no clue who I was.
      Can I sue a lawyer for mis-representation and ask the BK court to dimiss this on grounds that I was not represented in the true sense of the word? I am feeling a bit overwhelmed.
