    Pacer Questions

    Hi Everyone.

    I filed BK 7 on July 13 and my 341 meeting is scheduled for August 15. Last night, in order to keep tabs on my case, I signed up for Pacer. It was easy to find my case and I was also able to look at other cases that my attorney has handled. However, there were a couple things I couldn't figure out and I sure would appreciate any help.

    First, is there a way I could see what other cases are on the docket for August 15? To be totally honest, there is a BK attorney who used to attend our church and I'm fervently hoping I don't run into him on the morning of my hearing.

    Second, is there some way I could look up info on my trustee? I'm curious to know how he's ruled in other BK cases.

    I'll be grateful for any help or ideas. This forum is terrific! There's a great deal of comfort in knowing that I'm not alone. Thanks to all of you for your support, help and knowledge.

    Be sure to ask you attorney who your Trustee is! If it is the same person you go to church with - he will have to excuse himself from your case and get another attorney appointed. Find out soon, as this could delay your case.

    On pacer I dont believe you can pull up the listing for the docket for a certain day. Most searches are by name, ss# or case number.

    As far the your Trustee - He does not "rule" on your case. The judge does. The trustee is the attorney for the creditors in your case appointed by the court. More than likely all you'll ever know about your trustee, is name, address, and phone number. Unless you know someone who knows him personally.

    Go back and do some reading on this forum - others have expressed how their bankruptcy's turned out from start to finish. Many are quick and painless - but every so often one is "for the books"!

      Just to clarify, I don't know the trustee in my case. The person I'm trying to avoid at my 341 meeting is another BK attorney who used to attend my church. I'm simply trying to go on Pacer and view the court calendar for the morning of August 15 (which is when my hearing is). If I were to run into this man, especially in my current situation, I would feel pretty uncomfortable. But I'll just have to see what happens. If he is going to be in court representing another client, there's obviously nothing I can do; but, if possible, I'd like to know in advance.

      I did finally figure out how to go into Pacer and pull up court calendars. First I did a search on the date and was presented with a list of judges. I selected mine and was able to view what was going on. Regrettably, I couldn't pull up August 15 yet. The latest calendar in August was the fifth.

      Correct me if I'm wrong, please, but my understanding is that the trustee, and not the judge will preside at my 341 meeting. His purpose is to conduct the meeting of creditors, assuming any show up, and determine if there are any assets. (I have filed a no-asset case.) Assuming, there are no assets and no creditors object, the trustee will then recommend discharge to the judge and it is up to the judge to grant or not grant.

        Hopefully you can avoid the trustee you attend church with - that could be embarrassing I'm sure. I'm like most people, the least that know, the better. I find it embarrassing also to admit I had to file.
        Yes, you are correct about the trustee. He gathers all information, presents it to the court for approval. His main objective is to find assets he can dispose of for the the creditors.
        Some trustee can be extremely aggressive, requiring months and months of receipts, statements. Others accept what has been filed in your bankrupty package.
