    Stimulas package and not so good news

    We have included our 2006 taxes in our bk confirmed plan. We paid our 2007 taxes. I thought for sure we'd get a check since I called the IRS and they said yes, since you paid your 2007 taxes and although you are in bk you'll get a check. Surprise! Got a letter saying they're keeping the check 'cause we owe taxes from '06. So if anyone put their taxes (any year apparently) in their bk, looks like you won't be getting a check either.

    Make sure your attorney knows what they did because what you owe the IRS for your tax year 2006 is being paid for in total in your Plan to the IRS as a priority payment.

    I was told by the IRS and our attorney when we included our 2001 taxes in our filing in April 2002 that any refunds for years to come would not be touched because the 2001 taxes were being paid back under a payment plan via Chapter 13 bankruptcy. Seems like there have been changes or because this is a rebate check it is handled differently.

      We owe back taxes for 2005, 2006, and 2007. We included them in our paperwork because we had to include our taxes anyway. We were on a payment plan until we filed, at which point the IRS 'forgave' at least temporarily the payment plan. We will be extremely surprised if and when we do get Stimulus check. In any event, if we do get one, our Trustee will most likely want it.
