    Based on my recent BK filing, let me try and answer some of your questions.

    According to what my attorney told me, you can keep Direct TV, internet service is allowed, and you won't lose your cell phone service. These are all items that you will need to list on your expense sheet.

    If you're current with payments to your cell phone provider, service should continue as normal. However, if you're still under contract with your provider, you'll have to list the details in the paperwork when you file BK. There's a page where you have to list all of your contracts and leases.

    The fact that you are renting from a family member shouldn't be a problem, especially if you can provide documentation showing rent payments.

    I'm not sure about the car you sold. The sale was pretty recent. What did you use the money for and do you have back-up documentation?

    You mentioned that you just paid $400 to American Express. If you're seriously contemplating filing BK soon, be careful not to pay too much to any one creditor. This is considered preferential and the trustee may ask the creditor to return the money. The amount not to be exceeded is $600 and that's 90 days prior to filing.

      Check with two local bankruptcy attorneys in your area. Consultations are normally free. They will tell you which you will qualify for a 7 or 13 based on your info. Pick an attorney you feel comfortable with.

          I have paid more than 600.00 in the last 90-days to American Express; more like 750.00. I guess if they want it back that's ok but I was hoping to keep the AMEX since it has a 0-balance now. Anyone have any luck with keeping cards through the bankruptcy?

            You cann't pick and chose what you want to keep in as far as cc are concerned. Most will cancel your card the minute you file anyways. You will be told to surrender them or cut them up.

            Most people do not have any cc after bankruptcy but within a few months you will be offered them again - just at a higher interest rate. with low limits.

            Sometimes you will strike it lucky and you will find one that you have a zero balance on will let you keep it at a lower limit. Amer Exp is NOT ONE OF THOSE CARDS. They will ask for surrender or cutup.

            As far at the car sale - make sure you have receipts showing where the money was spent for the trustee.

              We had no balance due to Either Bank of America or Chase and we did not list them in our BK per our attorney. Neither one has requested them back.

                So far your lucky on the Chase and BOA, but when they do a updated credit check (yearly or every 6 months) and everything says BK on it......they'll probably call your cards in or reset you credit limit very low, and raise your interest rates. So be prepared.

                  Same with me. Granted, I filed Ch 7 about 15 years ago....the only card I didn't have a balance on at that time was Chase and my attorney advised me to keep it OUT of my BK because there was no balance. Chase never asked for it back nor did they increase my rate...and I still have the card today.
