    Frustrated w/Future Landlord

    I am so angry right now. My husband and I got approved for a rental house two weeks ago. We were asked to give a cashier's check for the security deposit a couple days after that and in return they would take the lockbox off the house. Normally we wouldn't do this without having a lease signed but they were still working on the lease and we gave in because they were willing to rent to us in spite of our bk. When the realtor got back into town she would send us the lease for us to review and set up a time to sign it. She got back into town on Monday and emailed us that she had contacted the landlord to get the lease. I get an email from her last night that she should have it by the end of the week and oh, by they way, the landlord decided to do a one year lease now instead of two like we had verbally agreed.

    I am so mad. I know our credit looks bad and we are a risk because we are in the middle of the bankruptcy but that doesn't give them the right to jerk us around and treat us badly. My husband just sent a strongly worded email to the realtor so we may be back to square one and have to start looking for a place again.

    I just want this to be over.

    This is one of the downfalls of filing Bankruptcy that I will be facing also. Im not looking forward to it.

      Yeah, I just get so angry because we have bent over backwards and been OK with it because we understand the position of the landlord and now they do this. I can't tell you how much paperwork we have submitted to them to make them feel better about renting to us.

      Basically my husband said in his email "Are you going to rent to us or not?". If not, fine and we will move on. I'm already making plans to look at other places in case this falls through.

        Evidently you are dealing with a realtor who in turn is dealing with a landlord that is out of state and everything is being done by "snail mail"........

        So be patient.......

        I understand your frustration at "waiting", but I'm sure the realtor has your best interest at heart trying to help you rent the place, and the landlord is only protecting "his interest" in requiring a yearly lease.

        "Snail mail" can try the best of nerves.......

          I wish I could give them that excuse but they are local. What I am more mad about is them changing the agreement. If they had said upfront that they would only do a one year I would have been fine with that. It's this changing their mind this late in the game. If they are this high maintenance now what are they going to be like when we acutally move in.

            This is a little off topic, but there is always the possibility that the landlord isn't shortening the lease because of you or your credit... maybe they're concerned about the economy and whether or not they'll be in a position to rent to you a year from now. Who knows what the landlord's financial state is.

            The couple next to us was renting while foreclosure was beginning and had no idea that our former neighbors were in trouble. The renters were told the owners were moving out of state but wanted to keep the house as an investment. You just never know... especially now.

              And... I totally understand your frustration. Nothing irritates me more than someone saying they're going to do one thing and then doing another. More than anything during the BK process you just want something, *anything*, to be stable and predictable... no surprises.

                Yes, Catdance, I tend to agree with Help on this one.. I know this whole rental issue has been trying for you, but I wanted to gently suggest that you try and not jump to conclusions too fast (I'm telling myself this same thing every day ) --maybe the landlord is trying to be proactive or in some financial uncertainty themselves at this time. I would try and roll a little on this one.. I hope it works out for you.

                  Perhaps a clause that grants a one year extension if all payments are made on time during the first year? I'm not sure but you might run that through and see what they say.

                    Well, I got more detail. The realtor said that they want to try and sell the house in a year. It could mean a couple of things...either financial instability, they are hoping the market will look better in a year and want to get rid of the property, or they are tired of being landlords. We'll see how this goes over the next week. The funny thing is they were the ones that were adamant about a 2 year lease which was fine with us since I don't to move after just a year and it take that long for us rebuild our credit and save for another house. We'll see how it goes over the next week or so.

                      I'm a little concerned that they wanted the cahier's check before anything was signed.

                      My husband and I are doing a 2 year lease/own. I looked into a foreclosure website that gives you a 10 day free trial. I wanted to make sure the house wasn't in preforeclosure before we signed the lease.

                      One of my friends fell in to a situation where they were renting and 5 months later, the sheriff came to their door. They had no clue the house was in foreclosure.

                        Yeah, we caved on the cashier check. We didn't want to give them one either but we also didn't want to lose the house. The realtor has already offered it back to us if we don't want to go through with the rental. We are seriously considering it.

                            I made sure I cancelled a few days later by email. It was very easy, no hassel.
