hello I am new Here, there is a ton of useful info on this site and sometimes it just helps to feel i am not alone in this mess...so Here goes
1. Filed Chapter 7 last year on all outstanding CC bills/etc....kept the first mtg 2nd mtg car payment...discharged June 2008
2. I filed alone, left my wife out of it..we still have two big debts in her name that I am now thinking about dis-charging.
So my question is....do i get a debt settlement for her approx 30K outstanding CC debt....or do I file Chapter 7 again for her or............we are having major problems paying the 2nd mortage...first is great rate, loan current.....2nd is bad rate, about 1 month behind but catching up with alot of OT last couple of months.
Could I do a chapter 13 with both of us or just her on the 2nd mortgae and her 30k?......struggling, no end in sight
The one postive is the first and second together equal what the house is worth, so I am not upside down on that at least....if i got what it is worth I could walk away debt free....but homeless....
