Anyone Else In Indiana

Is there anyone else in Indiana right now that is having to hold on to their Economic Stimulus checks without cashing them because of a ruling that they are waiting on in the court system about whether or not the trustees have the right to these checks or not?

We filed in Oct. 2007 and were discharged on Feb. 6, 2008 but our attorney won't let us do anything at all with our check until he finds out what the ruling is. We have been sitting on a $1,800 check since we FINALLY received it in June.

Is anyone else in any other state going thru this same thing?

My former business partner is going through his bankruptcy now; he tried to make a go of the business alone, but gas prices did him in, and his discharge is due later this month. I'm glad I filed when I did and didn't have to worry about this. He had to turn his $1200 stimulus check over to his attorney to hold until the court sorts things out, but not into the trustee's account.

Some trustees want the money in their hands even if it may need to be returned so they can keep the interest earned from the trustee's account.

I have to tell you....I saw a report on my Pacer which showed the breakdown of my assests which was just my 2007 Tax Refund that we had to turn over (all $4,300 of it) and it kills me. He gave us the $1,000 that he didn't keep and then the rest of it.....he hasn't even started giving any money to any of our creditors that have some forward.....it is just sitting in an account doing nothing but gaining interest. It is crazy! I had not seen one of these reports before until July 31st when it was filed with the court. I guess it says the next day to report on it is Aug. 30th. I will be interested to see what happens by then.

I'm from Indiana and we just had our 341 on the 23rd. of last month. Our trustee never even mentioned our stimulus check. He did ask us how we spent our income tax though, we told him we used it to pay our monthly bills. He seemed satisfied with that and never made a big deal about it. Our attorney told us it really matters where your located at it Indiana to how your bk will go.

It appears things are different here and there. I would hold it though. We are victims of Preferential payment to an insider, and got by with a time payment. You don't want to spend the money then have to give it back as it is a double whammy. 'Hub

Hi I am in Indiana but we are not filed yet. We waited because of the stimulus. We used kept all our receipts, most went to bills, repairs.... So I guess I am of no help. We did this at the advice of our attorney. But since you filed and then received it, it's a whole other story.

Anyway nice to see other hoosiers here. I know there are more, but I have not seen them on here for awhile. Hopefully they will pop in and catch your post.

I'm in Indiana and just filed on 7/31/08. The stimulus was never mentioned and it was long since spent on groceries, gas, etc. when I filed.
