    Motion to Convert Chapter 7 to Chapter 13

    O.K. where do I get a template, example, or form that would be accepted in the Western District of Virginia to create a Motion to Convert Chapter 7 to Chapter 13? I have searched the web extensively and nobody wants to give this stuff for free...what's up with that?...

    Don't mean to be sarcastic, but Nothing in this world is "free" - not even the air you breathe!! Need oxygen, you pay for it!!! That's how many of us got into this shape to begin with......

    If the forms are "not free" - you'll just might have to spend a few bucks - to ELIMINATE THOUSANDS..............

    Be "THANKFULL" you have an "open door" to ELIMINATE all your debts!!!

      Is this for you as a Debtor to convert your 7 to a 13?

      If you otherwise qualify for a 13, the US Trustee will probably make the motion anyway.

        If its for you as a Debtor, here is the basic text for a Motion to Convert, but you will still need a caption and to date and sign the motion.

        COMES NOW <your name>, debtor, and shows the court as follows

        1. Debtor filed a petition for an order for relief under Chapter 7 of the Bankruptcy Code on <date of filing>
        2. Debtor is qualified to file for relief under Chapter 13 of the Bankruptcy Code, having not previously converted this case from a case filed under Chapters 11 or 13 of the Bankruptcy Code, and herewith moves the court to convert the Chapter 7 case to a case under Chapter 13.

        A copy of the debtor's proposed plan is attached [or will be filed pursuant to Chapter 13 of the Bankruptcy Code].

        Wherefore, debtor prays for an order for relief under Chapter 13 of the Bankruptcy Code.

          Thanks for the info HHM. Another question: After I file the motion to convert the Chapter 7 to a 13, how many days do I have before the complete proposed plan must be submitted? Is it based on the timeclock of the original Chapter emergency petition filing that I did on 08/04 (meaning I need to have both the motion to convert AND the Chapter 13 plan submitted no later than 08/19), or, do I get a new 15 day clock and start over? or, do I have to wait for the Motion to be granted?....

            I assume when you say you filed an emergency petition that you only filed the two page petition cover sheet along with a list of creditors.

            If that is all you did, regardless of the motion to convert, you will need to complete the petition (all the other schedules) within 15 days from the date you filed.

            As for the Chapter 13 plan, I honestly don't know the answer to that question with regards to a motion to convert.
