    Need clarification of $ in back acct/filing

    Here I go again...I know the balance is supposed to be low but say i am filing Oct 22, and all I have left in my checking account is $1100. and that is my rent payment for Nov.

    1.Can the trustee take that amount? (filing Chap 7). Must I exempt it?

    We should get a tax refund and I was hoping to use the wildcard to exem pt that. (KY filing)

    Any input is greatly appreciated. Thanks so much to all you wonderful guys and gals

    I would not take the chance bk22, Can you pay ahead? You will have to declaire everything and it is a posibility that it could be attached in your estate. 'Hub

      Go to the bank and get a MO/counter check for your rent. That way the money is out of your acct. and accounted for.

        Thanks hub and OOH...I was worried it may be considered part of the estate. I will pay early...just did this month and asked landlord to cash as soon as he gets it. I tried to get a money order at the bank...but they will only do it for $1000., not 1100.

        Do you know where I can get a money order for $1100??

            There are postal money orders - don't know if they are limited that way.
            Filed Ch 7 -- July 9, 2008
            341 mtg ---- August 14, 2008
            Discharged ---- October 17, 2008
            Closed --------- December 11, 2009!

              I am pretty sure that postal money orders are limited to a certain amount. Things must be different from bank to bank, as I regularly purchase money orders over that amount to pay the trustee our Ch. 13 payment. I would just try buying two. It might cost you a few bucks, but I think the peace of mind would be worthwhile!

                Thanks everyone for your replies...I almost asked about two. I kinda wondered why the teller didn't suggest it. But I figured I'd just wait till next month and ask for two. Anyhow, thank you all for responding!!

                  Try these guys?

                  I go to Walmart to buy my money orders. They cost alot less tham the post office I find. It is still a money order-pays out the same. Where we are there is a Walmart every 10 miles, so look into them. Sometimes other stores, like Walmart offer them, also.
