    Question considering Bankruptcy

    Have been using a debt settlement company to resolve our cc debt. We have 2 of them paid off, the last one with interest is 14,000. This is my wife's cc before we met but we both used it when our job hours would slow. Anyway, she went to court in March of this year, judge asked if she contested the amount she said no and he told her to keep doing what we were doing, which was having a designated amount put in an acct. to pay it off. That was the last we heard until 9-19-08, when our checking acct. was frozen. My wife is unemployed because she lost her job, she gets unemployment benefits now and she is getting ready to start school. I work full time. We will have added debt because our son will be going to daycare(98.00 a week) We have a car payment, a house payment and home equity loan, we have some small debt on another cc we use when it gets tough and that is slowly creeping up. Was wondering if we would be a candidate for either ch. 7 or 13?

    First, what and why was your checking account froze? Also did the Judge give you a Court paper that stated what you should do? If not, word of mouth. I advise you in all due respect, to cut up that second card. That is the one that will ruin you, not the one you are paying. If you need to eat beans this week, do that. The second card is the "kiss of death", pay it off and destroy it.

    Ask for O.T. if you can. Perhaps cheaper child care, turn off all lights not needed, etc. You seem to imply you are getting on better if you can only get rid of this big card. Perhaps work with them.

    Although this is a bankruptcy forum, it is not good to do so particularly as young as you may be. It is the relief of last resort. Do anything you can not to bk, but when you have to then you have a final chance. I hope I helped a little. 'Hub
