    Another Queston, Please?

    I am opening a new checking account in the morning because of all the creditors having access to electronic check cashing, and this is what my lawyer advised.It's hard for me to close my account because of my payroll check being direct deposited, and also we're changing to a new pay system at my job this week.
    Here is my question. My husband just applied for a loan through his 401 K. The ammount is $1,000, and will only be used to pay our Mortgage and NSF charges through our current bank.I think this is okay, and we will be filng chapter 7 at the end of this month. Would we have problems if we instead used the money to file our bankruptcy right away as things are really heating up with our creditors and those payday loans. I wish we never would have taken out.The re-payment on the 401K will be deducted from my husbands check. Please advise, as I'm learning so much from this board and don't know what I'd do without your in-put, it's very helpful. I know that we have to make the final decisions, but with so many going through the same things as I am, it really helps. THANKS! Will the court get upset if we used the money for either of those things I mentoned?
