We were confirmed Chapter 13 July 31, 2008. My husband has been laid off two weeks ago. Our law firm told us that if something like this happens the bankruptcy rolls over to Chapter 7. I am sure there is a time frame. Does anyone know anything about this? I have tried to get an answer from my my lawyer for over a week.

I do not think that it simply rolls over. Our case was confirmed in December of 2007 and due to some paycuts we took, we are now in a Chapter 7. We had to meet with our attorney who then filed the motion to voluntarily convert our case to a 7 and our 341 meeting is November 5. It cost us $25 to convert our case. The trustee then stopped the automatic payroll deductions of our chapter 13 payments and I even received a refund check for a payroll deduction that was taken out on the same day that we officially converted. Everything, so far, has gone rather smoothly and hopefully there will be no problems at out 341. Keep trying to get answers from you attorney. You definitely want to convert and not dismiss and refile as a 7. That I do know, as the cost for the refiling is MUCH higher than the $25 we had to pay to convert. Good luck to you.
