    Hello all,

    I am curious, if a person files for business bankruptcy, can your home be searched for assets for that businesses?

    If the Trustee feels you might be hiding assets, yes he can send someone to look around. It however is not done on all cases, only probably a very small percentage of cases.

      Would the trustee have to have a court ordered search warrant?

        Nope. The debtor is under a duty to cooperate with the trustee. Thus, if the trustee wants to go, or send someone, to the debtors home, he can. It isn't going to be a "surprise" visit or anything like that, the trustee would schedule the visit with the debtor.

        I have only seen it done once, but that was in the case where the debtor had shut down the business and informed the trustee that many of the business assets were located in here garage at home.
