    How do you reschedule a hearing?

    My trustee wants to hold a hearing on Sept 8th before a judge to object to my claimed homestead exemption on the grounds I did not file a homestead deed within 5 days after the 341 mtg here in Virginia. I have a long planned vacation scheduled for then and need to reset the hearing date to something later that month. What is the form protocol I need to use and what are the odds I will get a new hearing date/ Do I contact the trustee, the judge, the clerk, who? DO I need to file a motion, a petition, a letter, what? (Of course I'm not going to mention the vacation excuse, but I'll call it surgey or something more justifiable)....

    The Trustee and court does not "reschedule" hearings for your convenience........
    So when you petition for a "new date" - you better be in the hospital or dead one......

    The Trustee is NOT SOMEONE you want to "mess" with..... or you take your chances......

    Which is more important right now - your "vacation" or "the rest of your life"..... Make your choice??

        well, if you really want it changed, the first person you call is the Trustee to see if he is willing to stipulate to move the date. (I wouldn't count on it though).

        Also, I don't think a long planned vacation is the best reason either. However, is this a trip your paying for, is this a family trip, etc.

          You can't lie and say you're having surgery. The court could ask for verification. Telling a trustee that you're too broke to pay your bills yet are going on a vacation doesn't look too good either.

          Your best choice is to reschedule the vacation and attend the hearing.
