    So im considering Bankruptcy, Have a few questions.

    So here i am, at the point where i feel i need to file bankruptcy. I am 24 years old, and its pretty sad anyway heres my info.

    i have 30k worth of debt in private student loans.
    i have 25k worth of credit card debt.
    I have no assets of any significant value. (except maybe my $1600 Keyboard)

    The problem started when i broke my ankle and i could not work, all my bills fell behind beyond the point where i could catch up. i had to move out of my apt. back to mom and dads. All that and bad spending habits led to this point.

    Should my first step be to find a lawyer? Also i recently got married about 4 months ago, will my wife be affected by this bankruptcy? All debt belongs to me, and most of it was accrued before me married but there is one credit card in which i just added her name as an extra cardholder so she could use it for emergencies. She did not sign anything. Will she be affected by this?

    I tried debt consolidation but the monthly payment is just too high for me to handle. I just dont make enough. We will be moving to our own place and i will have to pay rent so paying over 1k a month in debt just isnt an option.

    Would i file for chapter 7 or 13? Or should i just get a lawyer?

    chp 7 or 13 depends on your income, expenses, state, household size, etc . . . student loans aren't able to be discharged. it's a good idea to talk to a lawyer to get an idea of all your options and this forum will help answer a lot of questions.

    as for your wife, since she's not listed as a co-signer on anything you can file as single . . . however depending on your housing situation her income could be considered in determining your household income and whether you file for 7 or 13
