    Bankruptcy filing and check writing privileges

    I will be filing Chapter 13 in the next 2 or 3 days.

    I'm am worried about everything, and this woke me up this morning. My attorney advised me this week to close my bank account to stop 3 payday lenders from taking out anymore interest. I did and now I am worried.

    I will be filing either tomorrow or next week, but will these payday loan places report me to Telecheck, Certegy or SCAN. These were online loans using ACH withdrawal and NOT post-dated checks. My attorney said not to worry, but I am worry.

    I don't write bad checks, and the way my pay is deposited, the funds deposited (electronically) will cover all checks and EFT transactions written that day, but I can't get access to the funds until the next business day. There are times when I have to write a check to get groceries or gas instead of waiting the next day.

    Am I going to wake up and find that I can't write checks anymore? That is the one positive I have going for me is my debit history, my credit history has taken a nose dive and hasn't crashed yet. He said for me to file and fax them the petition with the case number and that they couldn't report me anywhere, but I need to know if others have had themselves reported to Chex, Scan, Certegy, or Telecheck for a bad check when in fact this is a personal loan (according to my attorney). He said that I might be reported to Teletrack but that if they reported me after I filed I could get them in court for violating the automatic stay.

    I need some peace of mind, does anyone have any suggestions. I am so worried about this I can't eat and sleep.

    I'm not really sure how to answer that one ...

    I've seen a similar post about a person whose checks got denied because of a situation like this and the reports to Telecheck; however, he then could turn around and use his check card to make the purchase and it was fine.

    When you open up your new account, make sure you get one with a check card so you'll still have access, that's the only advice I can give!
