    Met with lawyer and think I made a mistake!

    OK, I had an appointment with lawyer and was a little late.

    I hpoe I am not being picky, but this guy made me think twice about
    dealing with him.

    1. No suit, baggy shirt and short pants... (I filed before and my lawyer was dressed decently)

    2. I know it was easier before when I filed (No job) but he said "Just say or show you paid $250-$350 a month rent but you don't have to pay this" Now correct me if I'm wrong, but isin't this fraud?? (Looking for expenses so as to show hardship)

    3. I wanted to keep one card, he said that because of bankruptcy law, I cannot pick and choose unsecured creditors...But I did just that in my previous bankruptcy. (In fact, I had that one and another also asked me if I would consider reaffirmation to them too)

    OK, Let me hear your responses...I have not paid him anything as of yet, so I need the advice quick!

    Well first of all - first impressions are a huge factor - if you feel uncomfortable, that should say something.

    Directly responding to the questions (1) His dress would make me worried - would he wear that to court? (2) I don't understand ... you're not paying rent and he is saying to make it up? That sounds fishy... BUT (3) You can't pick and choose debt, I don't know how you did it before - why would you want too? If this is your second bankruptcy it should kind of tell you to get off of credit and start living within your means.

      Easy. If you aren't happy with the lawyer, go see another one. Otherwise, you will always wonder what if....
      While I don't necessarily say clothes alone don't make the man, the vibes you picked up are telling you something.
      My lawyer has done a lot of BKs, without any of them converting over or being dismissed. 800 or so. Check the guy out on Pacer.

        Pinktiger is right, I wish I would have checked my guy out before. I say go with the gut - have you already paid??

                Yeah I'd get rid of him. I had a tax issue a few years back that I ended up solving by myself. I found a local tax accountant that would help me for a few hundred dollars and stopped by his home office as per his request and he looked like a slob, there was laundry everywhere, the cat litter stench was permeating over the whole house, he opened his briefcase and wrinkled documents fell out (I could go on). The last thing I needed to resolve a federal tax issue was to have Oscar Madison help me. LOL He was upset when I grabbed my folder and ran out the door.

                Get another lawyer. There is a professional out there that will appreciate your business.

                    When you go into query - there's a selection box at the bottom (at least in WI courts) to select attorney. Type in his name and select attorney

                      A good BK lawyer knows how to "massage" client expenses (J Schedule) to allow for comfortable living. It can be considered malpractice not to. However, there are definitely limits! Of course all this changes after Oct. 17 - when we get to use the IRS guidelines.

                        Well...It matter little now...I was looking online for a new lawyer and danged in a creditor called...Quite nasty sounding and soooo..I read the speil my lawyer gave me and the creditor was quiet for a few seconds and then an "Oh this is just great" and they hung up...Check is in the mail to the lawyer..I will keep fingers crossed...
