    Completely Overwhelmed

    My fiance currently decided to leave me, I have 148,000.00 worth of debt that is outside of my current home debt. I am supposed to file BK7 in February. I have already paid the retainer for an attorney, he told me to stop making payments on everything that I could not afford anymore, Credit Cards, my new truck, a revolving loan account. So I closed my bank account so they could no longer do the draft payments, I have been telling the truck lender that I just cannot make the payment, as far as the credit cards go I just haven't told them anything. I also have a house that I signed over to an investor on land contract and he sold it on land contract to someone else, my name is still on the title and the city has condemend the property, I have to file bankruptcy or I will never be able to breath, I only bring home 1800 a month with a 1000 current mortgage payment and I have two kids and all of our other bills. What should I do? Is Bankruptcy the option I should take? I want to keep my current home....Thank you so much for any advice.

    Hi,

    Based on the income to debt ratio you presented. It appears as though filing a Chp7 would be your best option. Whenever a creditors calls, just give them your attorney's name and number, and tell them to deal with him/her directly. If you cannot afford to make your car payments, even after you stop paying on all your other discrentionary debts, then just arrange for a voluntary Repo with the lienholder. You should've kept your bank account open - especially if you weren't bouncing checks left and right, and simply cancelled any automatic deductions/allotments that you had. Because, some folks find it very difficult to obtain a checking/banking account post BK7.

      Bank Accounts

      Thanks Todd, I appreciate your advice. Thankfully I do still have a bank account, I opened a new one at a different bank, I tried to get the place to stop doing the electronic draft but they would not respond to any of my calls. Now I am getting letters from them to mail in my payments.
      if I do a voluntary repo how do I tell them that I am filing Bankruptcy if I am not filing until February? That is what worries me, what if they garnish my wages? If I loose this house I just don't know what I will do!!! Thanks again
