    You could start the ball rolling the day after she moves out technically. It is however generally better to complete the divorce first then the bankruptcy, this is assuming there is no possibility for reconciliation.

    You say the debt is yours, was she a co signer on any of the debt?

      Thanks for the response...

      My Wife was not a co-signer on anything of mine and there are no joint bank accounts or anything else shared...all of my bills, credit cards, loans etc...were prior to us being married...I now have a garnishment on my salary and two more have attempted to garnish but only one can do this at a time...

      Since you brought it up I am curious once my wife and I divorce and I go through with the bankruptcy, what would happen if we somehow ever did get back together. I know that's a real "what if" question but as much as it probably isn't realistic if that happened could they reverse a bankruptcy...

      And if I did want to go through with this as soon as she moves out would that make it harder to file for bankruptcy...

      Again I appreciate all of your responses...

        No if you later got back together that would not affect the bk.

        It wouldn't but if the sole purpose of the separation/divorce is bankruptcy you might considered married but filing alone bk option.

          Actually that is not the sole purpose it is a multitude of things. However, since this is happening I figured this would be the best time to start fresh. As for being married and filing separately that doesn't work because the first lawyer we spoke with said that as long as we are in the same residence her salary will be figured into the household bills etc...so this is not an option...

          A few more questions...

          If I start the bankruptcy proceedings once she is moved out would there be any extra hurdles as opposed to waiting for the official divorce...

          What do I need to show the lawyer and whoever else takes care of this...

          What are the average costs for this...lawyers etc...how do I know when I am paying too much...

          I appreciate all of your help...

            The main problem would be division of marital assets, so it could delay discharge/close until after the divorce decree would establish exactly what you own.
