    Ok, I need some advice and thought why not search the world wide web and get some advise from those who have walked in my shoes. First I'm single and have no kids and would be just for me. I've got an old school loan, credit cards, and many medical bills (just had heart surgery 3 months ago). Well, wasn't long ago I had an old apt complex put a garnishment on my wages, and had a 2nd medical company also put a garnishment on my wages at the same time. Long story short after paying my rent I'm down to 80 bucks that has to cover food, insurance and well lets just say I'm not sinking fast I'm sunk.

    First I've heard to sides to the being able to file and claim the old school loan in my filing of a bk. Can I file that?

    Secondly, where can I get a free credit report to get all my debtors so I don't miss any.

    Thirdly, I truly have no money for any lawyer ( I was reading on the costs on the board) and w/my debtors calling me and now putting garnishments on my wages I could never save up to pay a lawyer.

    And what is the difference between ch 7 and 13? Any help would be GREATLY appreciated as I'm tired of getting badgered by collectors and letters and especially the garnishments that has me to past broke. Thanks in advance for any advice

    A chapter 7 is a liquidation where any non exempt assets are sold by the trustee and distributed to the creditors.

    In a Chapter 13 you enter into a plan that can protect certain non exempt assets and the payments to the trustee are then distributed to the creditors. It is usually a 3-5 year plan.

    As far as I know Student Loans are not dischargeable in a BK.



    You might look for a lawyer that might do the case pro bono, or at a reduction. Otherwise you could do a pro se case.

    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.
