Question Chapter 13 Payment Default

If you're asking if anyone has missed a payment or two to their trustee, then yes, I have. Reactions will differ depending upon your trustee. Mine is very patient and understanding, and there were no consequences. Others on this forum have had a dismissal for missing just one. The best advice is make those payments, no matter what!

We are meeting with our atty tommorrow to discuss our options - through the life of our plan we have fallen behind and have now received a notice that the trustee wants to dismiss us with only 5 1/2 mos. to go. I have no idea what to expect, but he seemed promising in the regards that we do have options available to us.

We also have fallen behind because my husband lost his job of 18 years. Trustee did a motion to dismiss and our attorney has done a motion to forgive arrears - which is $6,000. It is set to be heard July 30th so we'll see how that goes. We are in a three year plan so if the trustee doesn't grant the motion to forgive arrears, I'm sure they'll just extend our plan by three months or so to allow us to make up the past due amount. At least I hope.
