Punitive charges discharged?

I am facing a personal injury lawsuit (premises negligence), with a lapsed insurance at the time, so I will most likely encure punitive charges. Could they be discharged in Chapter7?
Any help is greatly appreciated.

If the lawsuit is for just negligence and is not "willful and malicious" then it can be discharged in a Chapter 7.
