    Travel trailer question

    So today I see on Pacer that the bank the travel trailer is with has filed a Notice of Motion for relief from stay and abandonment.
    Our date for Objections is Oct 23rd and the hearing for this is set for October 27, 2009 @ 10 am.
    Should we attened this? or wil this be not needed since October 23rd comes first and I belive that to be our 60 days from 341 hearing (8/24/09)

    In the motion it states the NADA value to be $6,980.00 and balanced owed is $9,300.96
    Can we make an offer to get a new loan for the lower amount and keep the trailer?

    Just wondering and replies are greatly accepted with kindness.

    and BTW we were not going to keep the trailer.

      If you aren't going to keep the trailer, then the only reason to be at the Oct 27 hearing is if you wanted to stop the repossession and keep the trailer.

      If you decide to try to work with the lender to keep the trailer and renegotiate the loan terms or amount owed, you can try to do that. If you filed with a lawyer, be sure to let him/her run (or at least be aware of) these negotiations with the lender. However, there's no guarantee that you'll be able to reduce the amount owed or the interest on the loan. So far here in the forums, almost everyone who tried to renegotiate car or other non-home asset loans after filing have not been successful.

      If you want a real fresh start after filing, then dragging along assets that you may have to pay a third more than its value to keep doesn't make sense.
